Welcome to Tokr™. These Terms & Conditions (“Terms”) govern your access to and use of the Tokr™ mobile app, website (www.gotokr.com), and all related features (“Services”).
By using Tokr™, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree, you must stop using Tokr™.

Tokr™ is intended for adults age 21+ only (or the legal cannabis age in your jurisdiction). It is a platform for educational, informational, and legally compliant cannabis content only.
 

1. Eligibility

You may use Tokr™ only if:

• You are 21 years of age or older, OR the minimum legal cannabis age where you live.

• You can lawfully consume cannabis in your jurisdiction.

• You accept these Terms and our Privacy Policy.

Tokr™ does not permit accounts for minors. If we discover an underage user, the account will be terminated immediately.
 

2. Your Account

To use Tokr™, you must create an account using:

• Email + password, or

• Google Sign-In

You agree to:

• Provide accurate information

• Keep your login credentials secure

• Not share your account with anyone

• Notify us if you suspect unauthorized access

Tokr™ may suspend or terminate accounts that violate these Terms.
 

3. Permitted Use

Tokr™ is designed for:

• Legal cannabis education

• Strain discovery

• Dispensary location (where legal)

• User-generated content (“UGC”)

• Community learning

• AI-based cannabis information

You must not:

• Encourage illegal drug use

• Encourage excessive or irresponsible cannabis consumption

• Facilitate sales of cannabis outside licensed dispensaries

• Post content that targets or appeals to minors

• Use Tokr™ in locations where cannabis is illegal

• Use Tokr™ while driving or operating machinery

• Use Tokr™ to promote any illegal activity

Tokr™ does not sell cannabis.
 

4. User-Generated Content (UGC)

Tokr™ allows you to upload and share:

• Videos

• Photos

• Text posts

• Reviews

• Comments

By posting content, you agree that:

• You own it OR have permission to post it

• Your content does not violate any laws

• Your content follows Tokr™’s safety and community standards

• Your content does not encourage misuse or illegal activity

You grant Tokr™ a non-exclusive, worldwide license to:

• Host

• Stream

• Display

• Modify (for moderation or formatting)

• Distribute
  your UGC solely for the purpose of operating Tokr™.
   

5. Prohibited Content

You may NOT post:

• Illegal drug activity

• Encouragement of excessive cannabis use

• Content appealing to or depicting minors

• Pornographic material

• Hate speech, harassment, threats, or violence

• Copyright-infringing content

• Depictions of unsafe or impaired behavior

• Attempts to buy/sell cannabis illegally

• Spam or malicious content

Tokr™ may remove content at its discretion.
 

6. Community Safety & Moderation

Tokr™ includes safety tools required by Apple App Review:

6.1 Content Filtering

UGC is scanned through automated and AI-based moderation systems.

6.2 User Reporting

You may report:

• Videos

• Comments

• Profiles

Reports are reviewed within 24 hours.

6.3 Blocking

You may block any user.
Blocked users cannot:

• View your profile

• Comment on your content

• Follow you

6.4 Enforcement Actions

Depending on severity, Tokr™ may:

• Remove content

• Issue warnings

• Apply strikes

• Suspend accounts

• Permanently ban accounts

• Report illegal activity to authorities
   

7. Dispensary Locator & Location Data

The dispensary locator uses device location, but only if you grant permission.

If you deny location:

• Tokr™ still functions

• You can search manually

• We do not prompt you again

Location is used only for:

• Displaying nearby legal dispensaries

• Showing local educational content

• Legal compliance in restricted jurisdictions

• Regional advertisements

We do not use location for cross-app tracking.
 

8. Third-Party Services

Tokr™ relies on:

• Firebase (auth, analytics, crash reporting)

• Supabase (database & profiles)

• Mux (video hosting & streaming)

• AI moderation systems

These providers process data on behalf of Tokr™ only.

Tokr™ is not responsible for the content or practices of external links (e.g., dispensaries, brand websites).
 

9. AI Budtender Disclaimers

The Tokr™ AI Budtender:

• Provides educational information only

• Does not offer medical, legal, or professional advice

• Cannot diagnose, treat, or prescribe

• Should not be used as a substitute for certified professionals

You agree not to request illegal or harmful instructions from the AI.
 

10. Intellectual Property

All Tokr™ trademarks, logos, UI designs, text, features, and branding are the property of Tokr™.

You may not:

• Copy or reuse Tokr™ branding

• Reverse engineer the application

• Repurpose Tokr™ content outside permitted use

UGC remains your property, but you grant Tokr™ usage rights as described above.
 

11. Disclaimer of Warranties

Tokr™ is provided “as is” and “as available.”

Tokr™ does not guarantee:

• Accuracy of content or strain descriptions

• Availability or uptime

• Compatibility with your device

• Safety or legality of any dispensary

• Accuracy of AI-generated answers

You use Tokr™ at your own risk.
 

12. Limitation of Liability

To the fullest extent allowed by law, Tokr™ is not liable for:

• Loss of data

• Device damage

• Legal consequences from cannabis use

• Inaccurate information

• User interactions or disputes

• UGC posted by others

• Actions taken based on AI responses

Maximum liability is limited to USD $50 or the amount you paid Tokr™ in the last 6 months, whichever is greater.
 

13. Indemnification

You agree to indemnify and hold harmless Tokr™ and its affiliates from any lawsuits, damages, claims, or losses arising from:

• Your content

• Your actions

• Your misuse of the Services

• Your violation of these Terms

• Your violation of any law
   

14. DMCA Policy

If you believe your copyrighted material has been posted on Tokr™, notify:

Include:

• Your contact info

• Description of the work

• Link to infringing content

• Statement under penalty of perjury

• Electronic signature

Tokr™ complies with takedown and counter-notice processes.
 

15. Termination

Tokr™ may suspend or terminate accounts for:

• Violations of these Terms

• Illegal activity

• Content violations

• Safety risks

• Misuse

You may delete your account at any time in-app.

16. Governing Law

These Terms are governed by the laws of:
Los Angeles County, California, USA.

Disputes must be resolved in California state or federal courts.
 

17. Changes to Terms

We may update these Terms.
If changes are material, we will notify you via:

• In-app notifications, or

• Email

Continued use of Tokr™ means you accept updated Terms.
